Artikel 1. Applicability.

The General Terms and Conditions of Sale (hereinafter: Conditions) apply to all offers, orders and agreements of TheGemGirl.com. Accepting an offer or placing an order on the website implies that you accept the applicability of these Terms and Conditions.

Artikel 2. Offers/agreements.

All offers from TheGemGirl.com are without obligation and TheGemGirl.com expressly reserves the right to change prices. TheGemGirl.com cannot be held to its offers if the consumer, in terms of reasonableness and fairness and generally accepted views, should have understood that the offer or quotation or a part thereof contains an obvious mistake or error.

Artikel 3. Prices and payments.

The prices stated for the products offered are in euros, including VAT and excluding shipping costs or other levies, unless stated otherwise or agreed in writing.

Payment can be made through ideal, klarna, paypal, belfius and bancontact. When paying by bank or giro transfer, the date of payment is the date of crediting the bank account of TheGemGirl.com

Special offer prices are valid while supplies last and apply to new orders only.

Artikel 4. Shipping costs.

For shipments within The Netherlands, €5,95 shipping costs are charged for each order. Shipments to Belgium are charged €9.00 in shipping costs. For all shipments to other EU countries, €19.50 in shipping costs is charged. For shipments outside the EU, €29.00 is charged for shipping costs. Free shipping is offered for certain minimum amounts. Customer must select the free shipping option at checkout to use this. This cannot be adjusted or refunded after the order has been completed.

Artikel 5. Delivery adress and shipping time.


The consumer must at all times check whether the delivery address entered when ordering is still current. The delivery address that you specify when ordering, and the e-mail confirmation that you receive on which the delivery address is stated, is considered the delivery address and is processed as such by us.

If you have entered an incorrect delivery address, you can inform us as soon as possible by email at info@thegemgirl.com, after which the delivery address will be adjusted, if possible. After the order has been shipped, it is no longer possible to change the delivery address. TheGemGirl.com is not responsible for the incorrect delivery address and shipping of your order to the incorrect delivery address. For resending your order to a modified delivery address, shipping costs of €5,95 will be charged for a second shipment. (within NL)

Delivery by TheGemGirl.com takes place at the time when the products are ready for shipment to the consumer, as a rule this is approximately within 5 days (depending on the payment option chosen), but at the latest within the legally stipulated period of 30 days after ordering. unless otherwise stated.

I strive to pack and ship your order within 3 business days. This isn´t always possible, because it is a one-woman-business. A properly wrapped order with fun freebies is important to me.

Keep in mind it can take a little longer when there is a sale, because of the big amount of orders. When placing an order, you agree to this.

You will receive an email from myparcel with a tracking code when your order is on the way!

In the unlikely event that a product turns out to be out of stock, you will be notified asap. The money will then be refunded as soon as possible. This sometimes happens when there are big sales where many people order at the same time.

When a product is out of stock and is put on back order, the consumer will receive a message in the order confirmation by e-mail. The delivery time is also visible on the website when purchasing. Until the moment of completing the order, the consumer has the right to dissolve the agreement free of charge. The consumer can cancel the order by sending an email to TheGemGirl.com

Exceeding the delivery term does not entitle you to compensation.

Artikel 6. Warranty.

TheGemGirl.com guarantees that the goods that will be delivered meet the usual requirements and standards that can be expected and are free of any defects. Making a complaint is valid for a period of 7 days after delivery. This is a service. The invoice from TheGemGirl.com serves as proof of warranty for your order.

If the delivered goods do not comply with this warranty, TheGemGirl.com will provide a suitable replacement. This warranty does not apply if the defect has arisen as a result of improper use or if, without advice from TheGemGirl.com, the consumer or third parties have made changes or tried to make changes to the product or have used it for other purposes than which it is intended.

If the delivered product does not correspond to what was agreed and this non-conformity is a defect within the meaning of the product liability regulation, then TheGemGirl.com is not liable for consequential damage.

Artikel 7. Complaints and liability.

You have the obligation to inspect the delivered products immediately, but in any case within 7 days of receipt for completeness. You must report any defects that have been found to TheGemGirl.com within 7 days of discovery by e-mail. You can do this via info@thegemgirl.com

If it is shown that the products do not comply with the agreement, TheGemGirl.com has the choice to replace the products with new products upon return, or to refund the invoice price.

Returns
If the customer wants to return products, they have to make this clear within 14 days after receipt by the return form on the website. After applying for a return the customer has 14 days to send the parcel to The GemGirl.

ALWAYS fill in the return form and put a note in the box with the order number. If the customer doesn´t do these two things the return cannot be processed and may also be refused.

After receiving your return, you will receive your money back within 14 days, including the shipping costs of the order. The shipping costs paid for the return will not be refunded. If the entire order is not returned, you will only receive the amount of the returned goods. Goods must be shipped unused, undamaged and securely packaged to avoid damage during shipment. It is safest to return them in the same packaging. Always ship with a track and trace code! This is your return receipt. Always check whether your product meets the return conditions. Returns are always entirely at your own risk. The Gemgirl is not responsible for packages who get lost on the way.

Gemstones, minerals and fossils, they are all natural products. One more fragil than the other. These beautiful pieces are often extracted from mines, caves or deep inside the earth. Some are millions of years old! So it is not uncommon for there to be an unevenness in your piece such as an inclusion, hole or scratch. This is simply unavoidable and therefore cannot be accepted as a complaint. With fragil pieces such as sulphur, celestine and other quartz variants, a crystal can come loose during shipment, unfortunately this is also unavoidable despite solid packaging. Of course things change when your order comes in complete broken and damaged.

Returns are a major expense for a small business. it is absolutely understandable that sometimes you want to return something. However, if this happens very often and consistently, TheGemGirl reserves the right to no longer accept future orders.

Artikel 8. Retention of title.

Ownership of delivered products is only transferred when you have paid the entire amount that you owe TheGemGirl.com. The risk in respect of the products is transferred to the consumer at the time of delivery.

Artikel 9. Force Majeure.

Without prejudice to its other rights, TheGemGirl.com has the right in case of force majeure, at its own discretion, to suspend the execution of your order, or to dissolve the agreement without judicial intervention, by notifying you of this in writing. parts and this without TheGemGirl.com being obliged to pay any compensation, unless this would be unacceptable in the given circumstances according to standards of reasonableness and fairness.
